1. Introduction

Welcome to the CMJ McCarthy LTD t/a The Conveyor Shop. These Terms & Conditions govern your use of our website and the purchase of our products, including conveyors, parts, repair tools, and related services. By accessing our website or purchasing from us, you agree to comply with these Terms. Please read them carefully before proceeding further.

 2. Definitions

  • “Buyer” refers to any person or business purchasing products or services from The Conveyor shop
  • “Seller” refers to CMJ McCarthy LTD t/a The Conveyor Shop
  • “Products” refers to all items sold by The Conveyor Shop, including conveyors, scrapers, belts, drums, repair tools, and any other related items.
  • “Website” refers to www.theconveyorshop.com or any related subdomains.

 3. Orders

3.1 Placing Orders

All orders placed via our website, email, or phone are subject to acceptance by the Seller. We reserve the right to refuse or cancel any order at our discretion, particularly if the products are not available or if there is pricing or description error. 

3.1 Order Confirmation

Upon placing an order, you will receive an email confirmation with details of your order. This email does not constitute acceptance of the order but acknowledges receipt of your request. Once your order has been processed and shipped, a second email with shipping confirmation will be sent.

3.3 Pricing & Availability 

All prices listed on our website are in GBP (£) and include VAT (Value Added Tax) and shipping costs, unless stated otherwise. We strive to maintain accurate inventory, but availability cannot always be guaranteed. In case of discrepancies or shortages, we will contact you for alternatives or offer a refund.

4.Payment

4.1 Accepted Payment Methods 

We accept payments via credit/debit cards, bank transfers and other online payment gateways as listed on the website. Payment must be in full before your order is shipped, unless otherwise agreed upon in writing.

4.2 Billing Information

It is your responsibility to ensure that all billing details provided are accurate and up to date. Incorrect information may result in delays or cancellation of your order. 

4.3 Credit Terms

Credit terms may be offered at the sole discretion of the Seller, subject to the Buyer passing a satisfactory credit assessment. Where credit is granted, full payment of the price, VAT, and any other applicable costs is due within 30 days of the invoice date unless otherwise agreed in writing. If credit is not granted, payment must be made prior to the release of goods. 

4.4 Overdue & Failed Payments

The Seller reserves the right to charge interest on overdue invoices at a rate of 2% per annum above the base rate of the Seller bank, from the due date until full payment is received. If the Buyer fails to pay the full amount by the due date, the Seller is entitled to: 

  • Request payment in advance for any undelivered Goods.
  • Withhold delivery of any undelivered Goods without incurring liability for non-delivery or delays.

4.5 Bespoke Products

For bespoke items, design times and changes may extend to accommodate the Buyer’s needs. In such cases, the Seller may request additional payments to cover any extra costs incurred.

5.Shipping & Delivery

5.1 Shipping Methods

We ship products within the UK and internationally through trusted courier services. Shipping costs will be calculated at checkout and depend on the size, weight, and destination of the order.

5.2 Delivery Time

Delivery times are estimates only and may vary depending on the destination. For UK Buyers, typical delivery times range from 1-7 business days. International delivery times may vary. We will not be liable for delays caused by courier companies or customs. We aim to keep you informed of any significant delays. Any bespoke orders may take longer due to process, an estimated time of completion and delivery will be discussed on order.

5.3 Risk of Loss

Risk of loss or damage to the products passes to the Buyer upon delivery to the shipping carrier. It is your responsibility to inspect all items upon receipt and notify us of any issues immediately. 

6. Returns & Refunds

6.1 Your Right to Cancel (UK Consumer Rights)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, UK Buyers have the right to cancel orders for most products within 14 days of receiving them, unless the products are customised or made-to-order. You must inform us in writing if you wish to cancel your order within this time frame. Returned products must be in their original packaging and unused.

6.2 Return of Unused Goods

If the seller agrees to accept the return of non-damaged goods, the Buyer is responsible for covering the cost of return shipping and must ensure that the goods are properly packaged to prevent damage during transit. The seller reserves the right to refuse any goods that are damaged and will only accept returns for items listed in the Seller’s current Publication List. Credit will only be issued for goods returned in saleable condition. This does not apply to goods shipped from overseas intended for resale to third-party users.

6.3 Return of Bespoke Goods

All bespoke or custom-made items are non-returnable and non-refundable. Due to the personalized nature of these products, returns, exchanges, or cancellations will not be accepted once the order has been confirmed and production has commenced. Please ensure all specifications and requirements are thoroughly reviewed and approved prior to placing an order for bespoke items.

7.Termination of Contract

The contract of any bespoke work may be terminated at any time, provided that written notice is given to the Seller, subject to the following conditions: 

  • Any costs or expenses incurred by the Seller prior to termination must be covered by the Buyer.
  • Any deposits paid will be forfeited and applied against outstanding amounts.

8.Limitation of Liability

To the maximum extent permitted by UK Law, the seller will not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, business, or goodwill, arising from your use of our products or website.

In any event, our total liability to you for any damages related to the products purchased or use of our services shall not exceed the total amount paid by you for the products in question.

9.Intellectual Property

All content on the website, including text, graphics, logos, images, and software, is the property of The Conveyor Shop and is protected by applicable UK and international intellectual property laws. You may not reproduce, distribute, or otherwise use any part of our content without our written consent.

10. Privacy Policy

11. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from the use of our website or products will be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to amend or update these Terms at any time without prior notice. Any changes will be posted on our website, and your continued use of our services or purchase of products will constitute acceptance of the revised Terms.
